Report Inaccurate Information

Nebraska cannabis policy is changing rapidly: the pending Kuehn appeals at the Nebraska Supreme Court, the federal hemp cliff (November 12, 2026, PL 119-37 § 781), the federal Schedule III rescheduling implementation (April 2026 DOJ order), and the Omaha Tribe Title 51 rollout all introduce volatility. If you notice information on this site that is outdated or incorrect, please reach out and let us know.

Suggest Improvements

Is there a region, topic, or development we haven’t covered well enough? A new commission action? A 2026 election update? A Kuehn appeal ruling? An Omaha Tribe operational milestone? We’d love to hear your suggestions.

For Legal Advice

This site does not provide legal advice. For arrest situations, federal-employment matters, expungement petitions, or trafficking exposure, consult a licensed Nebraska criminal-defense or industry attorney with cannabis-policy experience. Nebraska State Bar Association Lawyer Referral Service: nebar.com / 402-475-7091.

Particular attention is warranted for:

  • Concentrate Class IV felony exposure (any vape cartridge with marijuana-derived oil = felony).
  • Cross-border-transport federal-felony exposure plus Nebraska state-law liability under § 28-416.
  • Drug tax stamp Class IV felony violations under §§ 77-4301-77-4316.
  • Cannabis DUI under impairment-only standard.
  • Civil-asset-forfeiture proceedings under §§ 28-431-440.05.
  • Pretrial diversion eligibility under § 29-3601.

For Medical Advice

This site does not provide medical advice. Initiative 437 patient certification requires a "valid signed and dated declaration" from a "health care practitioner" (MD, DO, PA, NP). However, as of May 2026 no Nebraska physician has publicly registered to issue medical-cannabis recommendations. Out-of-state telehealth practitioners may provide recommendations, though access to legal in-state product remains constrained pending dispensary licensure.

For Federal-Employment Questions

If you work for Offutt Air Force Base, U.S. Strategic Command, the 55th Wing, the National Strategic Research Institute, federal contractors with security clearances, or federal-grant-funded research at UNL or UNMC — cannabis use is a meaningful career-risk decision. Consult an employment attorney with federal-clearance experience before any cannabis use. The April 28, 2026 Schedule III rescheduling does not change federal drug-testing rules.
